Land Ownership – Personal Rights & Custodianship
What Does “LEGAL” Land Ownership, “Exclusive use Personal Rights” & “Custodianship” In The Project Mean? And How Must You Understand It?
This is a very important question – and needs a comprehensive proper answer.
To raise funds for conservation, we need to sell very special “gift” packages.
These gift packages include personal “exclusive use” rights and custodianship on a tiny parcel of land inside the Wild Flower Garden.
This means that when we talk about “tiny plots” or “land ownership” on Na-Koi-Ja-Ma Island, we basically say that we will allocate to you – or transfer to you, temporary “ownership” – or one can call it personal “exclusive use” rights to your plot – and/or – we give you “custodianship” of your plot. To us – all three of these concepts basically means the same thing: Its yours to enjoy – exclusively – within the rules of the Association.
The point is: We want to have a little fun with conservation! Life is already hard enough! It is hard for us, and it is hard on our planet…
So, let’s just have some fun. We want you to call yourself “KING…..” or “QUEEN…….” – and we will give you the papers and passport to prove you are king and Queen – of your own sponsored “exclusive use” domain.
We want you to be able to say that you have “exclusive use” property on Na-Koi-Ja-Ma Island, and we will give you the certificates to prove it.
I hope this make sense…
So, when you have custodianship of a parcel of land – you basically will also have some say as to the types of plants that you would like to plant on your plot, within the rules of the island, obviously. We are going to be populating your plot with plants on your behalf – and if you want to get involved in the process, it will be great!
The legality of the fact is: the South African property act does not allow for the registration of personal ownership of tiny plots of land at the deeds offices country wide, however – it does allow us to sell personal “exclusive use” rights and “custodianship rights” of land we personally own, to individuals, companies or trusts.
The internal “control of ownership” :
Here is what we do: – we have a Tiny Plot: Land Parcel Register Book: It’s a little bit like a personal mini “deeds office register”. The register is kept with our accountants and lawyers to insure accuracy, and to give credibility and accuracy to the process.
What we do is to notarize each of these tiny plots – each with it own unique number – and then match each plot with the name of its new owner in the register.
The registrations of all the tiny plots are thus notarized in our companies’ own records, and it also gets registered on our online platform, where our clients – who are the “plot” owners – have 24/7 access to.
When registration is done – plot owners receive a digital and printable copy of the signed and notarized certificate – which confirms the personal “exclusive use” rights and custodianship of each person’s plot on the island.
But here is something important:
As you can imagine, people and circumstance changes, and ownership – or rather, personal “exclusive use” rights and custodianship on plots changes too – the plots cannot be in one persons name indefinitely. We don’t live a 1,000 years, right? There has to be an end-date, or at least a re-view date.
To make this a fair and win-win offer for all – plot ownership, or personal “exclusive use” rights – or custodianship, whatever you want to call it, automatically lasts for a maximum period of 4 years, 4 months, 4 weeks and 4 days – and thereafter can then be extended.
If plot owners thus wish to extend their ownership on a plot of land for a longer period – during or before it lapses – they are welcome to do so. There is only a small renewal fee, to pay for the re-registration, that is applicable.
I know – question: So where does the 4-4-4-4-time period come from?
As you may remember from the Na-Koi-Ja-Ma story: “how long would it take to travel to the nearest star system – Alpha Century – from earth – or rather, from Na-Koi-Ja-Ma island?”
The answer is: exactly 4 years, 4 months, 4 weeks and 4 days.
